Permit amendment, revocation or transfer

The PUC has the authority to amend, revoke or transfer a permit for a large energy infrastructure project. This can be initiated by the PUC itself or in response to a request from an external party. 

Amendment

Amendment process:

  • Upon receiving a request for a permit amendment, the PUC will open a public comment period to gather feedback on the proposed change.
  • After the comment period closes and following an opportunity for the permit holder to present their case, the PUC will decide whether to approve the amendment.

Revocation

Revocation process:

The Commission can revoke a permit if it finds that the permit holder has acted in ways specified as grounds for revocation under the law.

The PUC cannot revoke a permit without first notifying the permit holder and ensuring they receive a fair opportunity to be heard and respond to the allegations.

Transfer

Transfer process:

  1. Petition submission: The permittee must submit a petition to the PUC. This petition must include:
    • The name and a description of the proposed new permittee.
    • The reason for the permit transfer.
    • The requested effective date of the transfer.
  2. Notice to interested parties: The current permittee is responsible for notifying all identified interested parties about the proposed transfer.
  3. Information from new permittee: The entity to whom the permit is proposed to be transferred must provide the PUC with any information necessary for the PUC to assess whether the new permittee can comply with the existing conditions of the permit.
  4. Commission approval: The PUC will approve the transfer if it determines that the new permittee will be able to comply with all permit conditions.
  5. Public meeting (optional): The PUC may choose to hold a public meeting to allow for public comment on the transfer request before making a decision.
